Are vapes legal in Mexico?
The situation of the vape market in Mexico is quite complex. Although the government has been committed to banning the use of vapes, consumers can still purchase vapes through legal channels. After the sales ban was implemented in 2022, the Supreme Court ruled the ban unconstitutional, leading to the ban being overturned, which allowed tobacco and vape companies to continue selling. As a result, vapes are commonly seen in the streets and alleys of Mexico. Based on a comprehensive analysis of multiple authoritative statistical platforms, by 2024, Mexico's vape market has surpassed $600 million, with over 1.5 million users.
However, in December 2024, the government passed a proposal to enshrine the vape ban into the constitution. This time, the situation may be different. Some distributors (e.g., Vapemex, EcigMex) have already stopped normal operations and raised calls to defend vape rights, while compliant companies like BAT have temporarily withdrawn from the market.
However, the vape market will not vanish. In Mexico, the black market, controlled by criminal organizations, still dominates the vape market. The government’s past lenient handling of the black market may not lead to a healthier development of the vape industry, but will only make it harder to protect the rights of vape consumers. The future of Mexico’s vape market in 2025 remains uncertain.
